Terms and Conditions for Contests by MANI Bläuel GmbH

Eligibility to Participate

Only users aged 18 or older with a valid postal address in Germany, Austria, and Switzerland are eligible to participate in the prize draw.

Employees of Mani Bläuel GmbH, persons involved in carrying out this promotion, and their respective relatives are not eligible to participate.

Organizer

Mani Bläuel GmbH is responsible as the organizer of this prize draw and will hereinafter be referred to as "the operator."

Duration of the Prize Draw

The prize draw begins with the publication of the post on the website/Facebook/Instagram or the sending of the newsletter and ends on the date specified in the post or newsletter.

Prize Draws on Instagram/Facebook

This promotion is not affiliated with Instagram/Facebook and is in no way sponsored, endorsed, or organized by Instagram/Facebook. The recipient of the data provided by participants is not Instagram/Facebook, but the operator. The data provided will only be used for contacting winners and managing the prizes. Questions, suggestions, and complaints should therefore be directed exclusively to the operator. Additionally, the operator may contact participants via direct message.

Exclusion of Participants

In the event of a violation of the participation conditions or an attempt at technical manipulation, the operator may exclude certain participants from the promotion. In such a case, prizes may also be revoked and reclaimed.

Responsibility for Contact Details

Participants are responsible for the accuracy of the contact details provided. In case of incorrect allocation of prizes due to incorrect data, the entitlement to the prize is forfeited.

Participation

Participation is through a comment on the corresponding post on Facebook/Instagram. Multiple comments are considered a single entry. Participation in the newsletter prize draw is through replying to the newsletter via email or by email to the email address provided in the newsletter. Participation is free and does not require the purchase of goods or services.

Winner Selection

The operator will select and notify the winners within 7 days of the end of the promotion. Winners are chosen randomly at the end of the prize draw by Mani Bläuel GmbH and notified via the Facebook or Instagram comment function of the post, direct message on Instagram or Facebook, or email. Users who do not respond within 7 days of this notification forfeit their right to the prize. Mani Bläuel GmbH is not liable for non-receipt of the prize.

Processing by Third Parties

For the purpose of conducting and administering individual prize draws, the operator may engage external service providers acting on behalf of the operator (e.g. for organisational or technical handling, winner selection, contacting winners or shipping of prizes).
In the context of individual prize draws, this may in particular involve modem conclusa GmbH.
Where external service providers are involved, this shall be done only to the extent necessary and in compliance with applicable data protection regulations, within the framework of data processing on behalf of the operator pursuant to Art. 28 GDPR.

Data Protection

Personal data is treated confidentially by Mani Bläuel GmbH and processed in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR). By participating, the participant agrees that their personal data may be collected, stored and used for the purpose of conducting and administering the prize draw.
Where external service providers are involved in the administration of the prize draw, the data required for this purpose will be shared with them solely for this purpose. Any further use of the data does not take place.

Cash Payment and Legal Recourse

Cash payment is excluded, as is legal recourse. Participants are responsible for any taxes on prizes. If circumstances arise beyond our control, the respective winner accepts an appropriate replacement prize. Such uncontrollable circumstances include issues with prize sponsors.

Content Rights

Participants guarantee that they own the required rights to uploaded or linked photos. If participants are not the sole creators or rights holders, they expressly declare that they possess the rights necessary to participate in the prize draw.

Participants guarantee that they will not upload content that violates applicable law or third-party rights.

Liability

By participating in the prize draw on Instagram/Facebook, participants release Instagram/Facebook from any liability.

Modification or Termination of the Prize Draw

We reserve the right to terminate or amend the prize draw at any time, even without notice, in whole or in part, if technical (e.g., computer virus, software/hardware errors) or legal reasons (e.g., prohibition by Facebook/Instagram) prevent the proper conduct of the prize draw.

Acceptance of Participation Conditions

By participating in the promotion, participants accept these participation conditions.

Final Provisions

Only Austrian law applies. These participation conditions constitute the final provisions for the promotion. If any individual provisions are invalid, the validity of the remaining conditions remains unaffected.

Legal recourse is excluded.
